Deborah A. Shapiro, LLC
The core of Deborah’s work involves evaluating and addressing conflict. When she conducts investigations, she identifies issues and determines the material facts underlying the complaints. When she audits investigations, she pinpoints best practices for handling future complaints. When she mediates, she helps parties find ways to end their disagreements. When she arbitrates, she ascertains the legal and contractual bases to resolve the disputes.
Deborah’s investigations involve a wide range of allegations, such as discrimination, harassment, assault, bullying, compliance violations, retaliation, disparagement, misconduct, misappropriation, and mismanagement. The allegations often originate from a report by an employee, an anonymous complaint, a lawyer’s letter, or an inquiry into a different matter. Many of these investigations involve allegations against CEOs and other C-suite executives, members of in-house legal departments, human resources professionals, and other highly sensitive relationships.
In conducting investigations, Deborah may draw upon a team of experts in a manner that is carefully tailored to the issues and sensitivities of the matter at hand. Deborah typically addresses issues relating to communications with stakeholders and witnesses, information gathering and analysis, fact finding, and reporting outcomes.
Deborah is accustomed to delivering findings in a clear and succinct manner to Boards of Directors, majority shareholders, and others with penultimate decision-making authority.
Deborah’s breadth of experience investigating and resolving disputes uniquely positions her to audit previously conducted investigations and advise upon the efficacy of current practices and processes. Deborah carefully examines organizational structure and analyzes the approach, conduct, and outcome of investigations. Deborah then pinpoints areas for improvement and discusses practical solutions.
As an arbitrator and hearing officer, Deborah addresses an array of conflicts, including private and public sector employment matters, securities issues, contractual claims, and legal fee disputes. As a mediator, Deborah focuses on resolving employment and contractual disputes, such as discrimination, harassment, wage and hour, and breach of contract matters. She mediates at various stages of conflict, including disputes between current employees and pending litigation.
Deborah teaches at NYU School of Law and Fordham University School of Law. She also speaks at industry conferences, on panels, and at educational institutions regarding investigations, employment law, negotiations, alternative dispute resolution, and related topics.
